Order acceptance
The contract shall consist only of our offer and your acceptance of the Order Form and these terms, nothing else shall form part of the contract and be binding on either you or us. It is our responsibility to supply you with goods that meet your consumer rights. Nothing in this contract affects your statutory rights.
Payment
A deposit is required upon order with the balance payment becoming due upon satisfactory installation.
Installation
We will endeavour to deliver and install your stairlift on the date provided, however, in circumstances beyond our reasonable control we will not be held liable for costs incurred if we cannot meet this date. Such causes include, but are not limited to: weather, traffic, breakdown or illness.
Power supply/alterations
You must provide a suitable 13-amp socket or fused spur which can only be used for the stairlift. If this is not available, you must make arrangements to have one fitted before we install the stairlift. If we agree to do any extra work as detailed in the Notes & Recommendations box on the front of this order form, we will either carry out the works ourselves or if necessary we may employ someone who is qualified to undertake such work, who may be a sub-contractor. Please note that as a result of any agreed work, it may be necessary for you to carry out some redecoration work and/or carpet replacement.
Safety
If we are not able to install your stairlift for safety or other practical reasons, we will be entitled to cancel your order, even if we have already accepted it. If we do this, we will return any deposit you have already paid us as soon as possible.
Your right to cancel
You have the right to cancel this contract within the 14 days without giving reason. The cancellation period will expire 14 days after your order has been confirmed. To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or email) addressed to Associated Stairlifts Limited, 41 Kenilworth Drive, Oadby Industrial Estate, Oadby, Leicester LE2 5LT or email to info@associatedstairlifts.co.uk. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
When you sign our order form it does however state that you would like us to start work or install your stairlift within this cancellation period in order to help you faster, therefore should you cancel you will lose your deposit and will be liable for any reasonable costs for work carried out prior to your cancellation notice.
If you would like to continue to exercise your rights to this cancellation period then please make a note in the Notes box on the reverse of these terms that you would like us to place your order on hold until 14 days after the order form is signed.
Who owns the stairlift
If you are purchasing a stairlift, You will only own the stairlift when you have paid us the total order value in full. If you are renting a stairlift from us then your stairlift remains the property of Associated Stairlifts at all times and is only on rent to you for the duration of time required.
Your warranty
Our new stairlifts come with a minimum 2 year warranty, our reconditioned stairlifts come with a minimum 1 year warranty and our rental stairlifts come with a full warranty for the duration of the rental. Your warranty applies from the date that we install your stairlift and covers the cost of parts and labour for faulty manufacture or installation. It does not cover issues caused by user error or if the stairlift is, or has been, used incorrectly or has been damaged or misused by yourself or by other people. We will contact you when your initial warranty expires to ask if you would like us to carry out an annual service to keep your stairlift in good order moving forwards into the following year. (chargeable at our current service rate)
In the event of a breakdown
In the unlikely event that you experience a breakdown with your stairlift, we will always do what we can to ensure we get you up and running again as soon as possible, this may be achievable over the phone or it may require an engineer to visit you.
We are not an emergency service so we cannot necessarily guarantee that we will be able to get an engineer out to you straight away, so assistance with the stairs or temporary downstairs accommodation may be required. However should the unfortunate situation arise, we will endeavour to be out to you within 24 hours of your call being logged with us. (subject to illness, adverse weather conditions or reasons beyond our control) Please note that we do not attend breakdowns on bank holidays.
Our opportunity to put things right
We are aware there are times when things go wrong, if you suffer any loss or damage as a direct result of our negligence, then we request you allow us a reasonable opportunity to remedy the problem. In order for us to do so, we may be required to appoint/consult with subcontractors or carry out an effective repair ourselves. We will not be responsible for any loss or damage which you fail to allow us a reasonable opportunity to put right and/or which could have been avoided or minimised by you taking reasonable steps which you failed to take. Moreover, you will be consulted throughout the process until a final remedy has been agreed.
Liability
We will not be liable for any alterations or modifications made to the stairlift without our knowledge. This agreement shall not limit nor exclude liability for death or personal injury caused by our negligence.
Law
English law and the jurisdiction of the English courts shall apply to this Contract.
